Mother of South Bay Truck Accident Victims Files Suit

Back in March, a devastating truck accident involving a tractor trailer that detached claimed the lives of four people and injured two others.   The accident occurred on U.S. 27 in Palm Beach County in the early morning hours.  A trailer suddenly became detached from a truck, coming to rest in the middle of the roadway.  The trailer was shrouded by the fog and multiple crashes resulted from drivers running into the trailer.

The first accident involved a 2008 Ford Focus driven by 39 year old Carolina Ortiz.  She swerved to avoid the trailer, but ran into its right rear corner.  Moments later, an approaching tractor trailer slammed into the Focus and sent it spiraling to the side of the highway.  Ortiz was carrying four passengers.  Two other vehicles then crashed in an attempt to avoid the trailer.  Ortiz and three of her passengers were killed in the accident.

Now, the mother of Carolina Ortiz has filed a wrongful death lawsuit against the other drivers involved in the accident.  She is seeking compensation from the drivers of the tractor trailer that detached and the truck driver that hit her, along with the owner of the trailer that detached and the owner of the tractors.

Truck Accident Claims Often Involve Multiple Parties

A simple car accident may just include one defendant, but any major truck accident case will typically involve more than one defendant.  Truck accident cases are usually filed against the truck driver and the trucking company that employs the driver.  Sometimes, the truck is owned by a different party and this party will be attached to the suit.  At times, as in this action, the trailer was also owned separately and this owner will be included in the lawsuit.  Other potentially negligent parties include a garage or repair shop that failed to make adequate repairs, or a truck or trailer manufacturer that designed or released a defective product.

As is evident from the multiple potential defendants in any truck accident case, truck accident cases add a different level of complexity as compared to most car accident actions.  This makes it particularly important for truck accident victims to obtain experienced counsel to assist in their case. Truck accident victims will often experience more serious injuries than the average car accident victim due to the size and weight disparity between the two vehicles.  Occupants of the passenger vehicle may suffer with long term and costly injuries that require adequate compensation.  However, commercial trucking companies are generally large corporations with extensive resources and legal teams to defend them in the event of a lawsuit.  These companies may offer plaintiffs quick settlements that may seem appealing, but are for far less than the plaintiff would have received in bringing an action.

With all of these complexities and challenges, it is imperative that you seek a truck accident attorney with considerable experience in this unique field of law.  Find a truck accident attorney with knowledge as to federal trucking regulations, a history of negotiating strong settlements, and a passion for seeing that your case reaches the best possible result.
